Whoever assaults or threatens to assault or obstructs or attempts to obstruct any member of the Executive or Magistracy in the discharge of his duty for the purpose of dispersing an unlawful assembly or of suppressing a riot or affray shall be punished with imprisonment of either description for a term which may extend to three years or with fine or with both.
